1. General provisions
This document describes the process for submitting a request to add a brand to the app through the service interface.
2. Application, links, and brand
A request to add a brand to the app may be submitted through the service.
If moderation is successful, branded links to install the app from the App Store and Google Play may be sent to the email address provided.
The app listing in the stores does not change; a separate store listing and a separate build for the applicant’s brand are not created.
When the app is installed via a branded link, the applicant’s brand may be shown inside the app.
3. Applicant representations and limitation of contractor liability regarding brand materials
The applicant represents that they have all rights required for the trademarks, logos, names, images, and other materials supplied for displaying the brand in the app, and that use of these materials in the app does not infringe third-party rights.
The applicant is solely responsible for the content, completeness, and lawfulness of the materials provided.
The contractor is not obliged to independently verify the existence or scope of the applicant’s rights in such materials.
If third parties bring claims, demands, or lawsuits against the contractor relating to the applicant’s brand materials, the applicant shall resolve such matters at their own expense and reimburse the contractor for documented losses arising from such matters, including legal costs and awarded penalties, to the extent permitted by applicable law.
4. Public distribution and monetization
Links and screenshots may be shared in public channels subject to app store rules and applicable law.
Users who install the app via branded links use the app on the same terms as the service, including all current and future monetization models (including ads, subscriptions, one-off purchases, and other mechanisms).
No share of revenue from such users is paid or owed to the applicant.
5. Express disclaimer of obligations
This document, as well as submitting an application, moderation, correspondence, providing links, and using them:
- do not create an obligation for the applicant to pay for use of the app;
- do not create an obligation for the contractor (rights holder of the app) to pay the applicant remuneration for use of the applicant’s brand in the app;
- do not create an obligation to approve the application;
- do not create an obligation to meet deadlines;
- do not create an obligation to provide compensation, reporting, payments, revenue sharing, or percentages (except reimbursement of the contractor’s losses to third parties as expressly described in the section on brand materials);
- do not create an obligation to achieve specific metrics (installs, conversions, revenue, ratings, visibility, etc.);
- do not create any other mutual obligations except those expressly stated in the section on brand materials.
6. Limitation regarding iOS
Due to technical constraints of the Apple ecosystem, it is impossible to guarantee with 100% certainty that a user who follows a branded link and installs the app from the App Store will see the applicant’s brand on the device.
7. Acceptance
Confirmation in the service interface (checkbox, button, or equivalent) means that you have read this document, including the sections on representations regarding brand materials, monetization, express disclaimer of obligations, and the iOS limitation.
